TERMS OF SERVICE

These Terms of Service (“Terms”) apply to use of the MyMoments mobile application (the "MyMoments App”), the http://cloud.mymoments.org or http://resilience.mymoments.org facilitator platform, or www.ediinstitute.org (the “EDI Website”) (collectively, the “Services”).
BY CLICKING THE “I HAVE READ AND ACCEPT OUR TERMS OF SERVICE AND OUR PRIVACY POLICY” BUTTON, YOU:
1. ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS AND OUR PRIVACY POLICY SET FORTH BELOW; AND
2. ACCEPT THESE TERMS AND AGREE THAT YOU ARE LEGALLY BOUND BY THEM.
IF YOU ARE USING THE SERVICES ON BEHALF OF YOUR EMPLOYER, YOUR ACCEPTANCE OF THESE TERMS IS DEEMED AN AGREEMENT BETWEEN YOUR EMPLOYER AND EDI INSTITUTE AND YOU REPRESENT AND WARRANT THAT YOU HAVE AUTHORITY TO BIND YOUR EMPLOYER TO THESE TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ACCESS OR USE THE SERVICES.
LICENSE GRANT
You acknowledge and agree that the Services are licensed and not sold to you.Subject to these Terms, EDI Institute grants you a limited, non-exclusive and nontransferable license to access and use the Services for your personal, non-commercial use on a mobile device or computer owned or otherwise controlled by you ("Your Device").
EDI Institute and its licensors and service providers reserve and shall retain their entire right, title and interest in and to the Services, including all copyrights, trademarks and other intellectual property rights therein or relating thereto, except as expressly granted to you in these Terms. You do not acquire any ownership interest in the Services through these Terms or any other rights thereto other than to use the Services in accordance with and subject to all terms, conditions and restrictions in these Terms.
RESTRICTIONS ON USE OF THE SERVICES
You shall not:
- copy the Services, except as expressly permitted by these Terms;
- modify, translate, adapt or otherwise create derivative works or improvements of the Services;
- reverse engineer, disassemble, decompile, decode or otherwise attempt to derive or gain access to the source code of the Services or any part thereof;
- remove, delete, alter or obscure any copyright, trademark, patent or other intellectual property or proprietary rights notice from or in the Services;
- rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer or otherwise make available the Services or any feature or functionality of the Services to any third party for any reason, including by making the Services available on a network where it is capable of being accessed by more than one device at any time;
- remove, disable, circumvent or otherwise create or implement any workaround to any copy protection, rights management or security features in or protecting the Services; or
- submit any information about or from a third party to or through the Services unless and until you have legally-valid written consent to do so.
INFORMATION PROCESSING
All information we collect through or in connection with the Services is subject to our Privacy Policy set forth below. By using and providing information to or through the Services, you consent to processing your information in compliance with the Privacy Policy.
USER CONTRIBUTIONS
EDI Institute may offer you access to web pages or screens in the Services on or through which you and others can display, publish or submit (“Post”) information (including original and modified photographic images and corresponding captions) or otherwise provide feedback or information to EDI Institute (“User Contributions”). By Posting or transmitting User Contributions to EDI Institute (or EDI Institute’s designees) through the Services, you grant EDI Institute and EDI Institute’s designees a worldwide, non-exclusive, sub-licensable (through multiple tiers), transferable, royalty-free, perpetual, irrevocable right to use, reproduce, sublicense (through multiple tiers), distribute, create derivative works of, perform and import your User Contributions in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without compensation to you.In other words, EDI Institute has the automatic right to use your User Contributions -- including reproducing, disclosing, Posting or broadcasting your User Contribution -- anywhere, anytime, in any medium and for any purpose.Unless expressly authorized in advance and in writing by EDI Institute’s authorized representative, you are not entitled to payment if EDI Institute uses one of your User Contributions.All User Contributions are deemed non-confidential and non-proprietary.
You are the owner of and responsible for your User Contributions. In consideration of your opportunity to use the Services to post a User Contribution, you represent and warrant that:
- you own or otherwise control all of the rights to your User Contribution;
- your User Contribution is true and accurate;
- your User Contribution does not infringe, misappropriate or violate any third party’s copyright, trademark, patent, literary, trade secret, privacy, publicity or other proprietary right;
- your User Contribution does not contain information that identifies any person unless you have such person’s express prior written consent
- your User Contribution does not make unsubstantiated claims about any third party or its products or services or contain any slanderous, defamatory, obscene, pornographic, threatening and/or harassing comments or other content; and
- your User Contribution complies with all applicable laws, rules and regulations.
If you are responsible for submitting a User Contribution on behalf of another person, you agree not to submit any information that would directly identify that person.
If you are a California resident under age 18 and are an authorized or registered user of any of the Services, then you may request that we remove any User Contribution that you publicly Posted through the Services.Please see our Privacy Policy below for more information.
GEOGRAPHIC RESTRICTIONS
The Services are based in the United States and provided for access and use by persons located in the United States. You acknowledge that you may not be able to access all or some of the Services outside of the United States and that access thereto may not be legal by certain persons or in certain countries. If you access the Services from outside the United States, you are responsible for compliance with local laws.
UPDATES
EDI Institute may from time to time in its sole discretion develop and provide upgrades, bug fixes, patches and other error corrections and/or new features (collectively, "Updates"). Updatesalso may modify or delete in their entirety certain features and functionality. You agree that EDI Institute has no obligation to provide any Update or to continue to provide or enable any particular feature or functionality. All Updates are deemed part of the Services and subject to these Terms.
Based on Your Device settings, when Your Device is connected to the internet either the Services will automatically download and install all available Updates or you may receive notice of or be prompted to download and install available Updates.
You understand that the Services may not properly operate if you do not install Updates.
THIRD PARTY MATERIALS
The Services may display, include or make available third-party content (including data, information, applications and other products services and/or materials) or provide links to third-party websites or services, including through third-party advertising ("Third Party Materials"). You acknowledge and agree that EDI Institute is not responsible for Third Party Materials, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. EDI Institute does not assume and will not have any liability or responsibility to you or any other person or entity for any Third Party Materials. Third Party Materials and links thereto are provided solely as a convenience to you and you access and use them at entirely at your own risk and subject to such third parties' terms and conditions.
TERM AND TERMINATION
These Terms are binding on you when you use the Services and remain in effect until terminated by you or EDI Institute.
You may terminate these Terms by deleting the Services and all copies thereof from Your Device. EDI Institute may terminate these Terms at any time without notice if it ceases to support the Services, which EDI Institute may do in its sole discretion. In addition, these Terms will terminate immediately and automatically without any notice if you violate any of the terms and conditions in these Terms.
Upon termination, all rights granted to you under these Terms also will terminate and you must cease all use of the Services and delete all copies of the Services from Your Device and account.
Termination will not limit any of EDI Institute's rights or remedies at law or in equity.
DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, EDI INSTITUTE ON ITS OWN BEHALF AND ON BEHALF OF ITS LICENSORS AND SERVICE PROVIDERS, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE APP, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OR TRADE PRACTICE. WITHOUT LIMITATION TO THE FOREGOING, EDI INSTITUTE PROVIDES NO WARRANTY OR UNDERTAKING, AND MAKES NO REPRESENTATION OF ANY KIND THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS OR BE ERROR FREE OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON IMPLIED WARRANTIES OR THE LIMITATIONS ON THE APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
You agree that EDI Institute assumes no responsibility for your User Contributions or other content you make available through the Services.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EDI INSTITUTE OR ITS LICENSORS OR SERVICE PROVIDERS HAVE ANY LIABILITY ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES FOR: PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION OR ANY OTHER CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL OR PUNITIVE DAMAGES; OR DIRECT DAMAGES IN AMOUNTS THAT IN THE AGGREGATE EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SERVICES.
THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR EDI INSTITUTE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY SO SOME OR ALL OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.
You acknowledge and agree that the above limitations of liability, together with the other provisions in these Terms that limit liability, are essential terms and that EDI Institute would not be willing to grant you the rights set forth in these Terms but for your agreement to the above limitations of liability.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE YOUR RIGHTS WITH RESPECT TO CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”
INDEMNIFICATION
You agree to indemnify, defend and hold harmless EDI Institute and its officers, directors, employees, agents, affiliates, successors and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to your misuse of the Services or your breach of these Terms.
APPLE DEVICE ADDITIONAL TERMS
If you access the Services via a mobile device or tablet branded by Apple, Inc. (“Apple”) and running Apple’s iOS (an “Apple Device”), the following terms (“Apple Device Additional Terms”) are hereby made part of these Terms:
Conflicting Terms. If these Terms conflict with the Apple Device Additional Terms, then the Apple Device Additional Terms shall apply with respect to access and use of the Services via an Apple Device.
Agreement with EDI Institute, Not Apple. You acknowledge that these Terms are an agreement between EDI Institute and you, and not with Apple. EDI Institute not Apple, is solely responsible for any application you access via your Apple Device (“iOS App”) and the content thereof. If these Terms are less restrictive with respect to an iOS App or otherwise conflict with, the Apple App Store Terms of Service, the App Store Terms of Service shall apply to the extent of any conflict.
Scope of License. The license granted to use an iOS App is limited to a non-transferable license to use the Services on an Apple Device that you own or control and as permitted by the usage rules set forth in the App Store Terms of Service.
Maintenance and Support. EDI Institute is solely responsible for providing any maintenance and support services for any iOS App it offers to you. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to any iOS App.
Warranty. EDI Institute is solely responsible for any product warranty, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of an iOS App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the iOS App (if any) and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS App and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty is EDI Institute’ sole responsibility.
Product Claims. You hereby acknowledge that EDI Institute, not Apple, is responsible for addressing your or any third-party claims relating to an iOS App and/or use of an iOS App, including, but not limited to: (i) product liability claims; (ii) any claim that an iOS App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. These Terms do not limit EDI Institute’ liability beyond what is permitted by applicable law.
Intellectual Property Rights. You acknowledge that, in the event of any third party claim that an iOS or your possession and use of an iOS App infringes that third party’s intellectual property rights, EDI Institute not Apple, is solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Third Party Beneficiary. You hereby acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms with respect to any iOS App, and that, upon your acceptance of these Terms, Apple has the right (and deemed to have accepted the right) to enforce the Terms against you with respect to the iOS App as a third party beneficiary thereof.

CHANGES TO TERMS
The Effective Date of these Terms is set forth at the top of this webpage.As we add new features, we may amend or supplement these Terms.We will provide you with advance written notice of material changes to these Terms and will not make changes that have a retroactive effect on your privacy rights unless we are legally required to do so or to protect other users.Your continued use of the Services after the Effective Date constitutes your acceptance of the amended Terms. The amended Terms supersede all previous versions of, or agreements, notices or statements about, the Terms.
ADDITIONAL TERMS
Certain features of the Services may be subject to additional terms and conditions (“Additional Terms”) presented in conjunction with them.EDI Institute may present Additional Terms to you through the Services or offline. Regardless of how they are presented to you, EDI Institute requires that you agree to Additional Terms before using these features of the Services. Unless otherwise specified in Additional Terms, all Additional Terms are incorporated into these Terms.If you do not agree to Additional Terms, you will not have access to the Services to which they relate.These Terms and Additional Terms apply equally. If, however, any Additional Term is inconsistent with any provision of these Terms, the Additional Term will prevail but only for parts of the Services to which the Additional Terms apply.
MISCELLANEOUS TERMS
Electronic Signature. Your affirmative act of using and/or registering for the Services constitutes your consent to enter into agreements with EDI Institute electronically.
Export Regulation. The Services may be subject to US export control laws, including the US Export Administration Act and its associated regulations. You shall not, directly or indirectly, export, re-export or release the Services to, or make the Services accessible from, any jurisdiction or country to which export, re-export or release is prohibited by law, rule or regulation. You shall comply with all applicable federal laws, regulations and rules, and complete all required undertakings (including obtaining any necessary export license or other governmental approval), prior to exporting, re-exporting, releasing or otherwise making the Services available outside the US.
US Government Rights. The Services are commercial computer software, as such term is defined in 48 C.F.R. §2.101. Accordingly, if you are an agency of the US Government or any contractor therefor, you receive only those rights with respect to the Services as are granted to all other end users under license, in accordance with (a) 48 C.F.R. §227.7201 through 48 C.F.R. §227.7204, with respect to the Department of Defense and their contractors, or (b) 48 C.F.R. §12.212, with respect to all other US Government licensees and their contractors.
Severability. If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms will continue in full force and effect.
Governing Law. These Terms are governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts, United States, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Massachusetts in each case located in Boston and Suffolk County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Limitation of Time to File Claims. ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and EDI Institute with respect to the Services and supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the Services.
Waiver. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder. In the event of a conflict between these Terms and any applicable purchase or other terms, the terms of these Terms shall govern.

EDI Institute, Inc.("EDI Institute" or "We") respect your privacy. This Privacy Policy describes how EDI Institute collects, uses, discloses, stores and otherwise processes information submitted to or through the MyMoments mobile application (the "MyMoments App”), the http://cloud.mymoments.org o http://resilience.mymoments.org facilitator platform, or www.ediinstitute.org (the “EDI Website”) (collectively, the “Services”).
This Privacy Policy is incorporated into and made a part of our Terms of Service set forth above. If you have not done so already, please also review our Terms of Service because they contain provisions that limit our liability to users of the Services and require users to resolve any dispute with us on an individual basis and not as part of a class or representative action.
By downloading, accessing or using the Services, you agree to this Privacy Policy and our Terms of Service.If you do not agree with this Privacy Policy or our Terms of Service, then please do not access, download or use the Services.
SCOPE
This Privacy Policy applies to information submitted to and through the Services by authorized users.This Privacy Policy does not apply to information collected off line or by any third-party website or service accessible through the Services.
EDI Institute has written agreements with certain organizations for use of the Services.If a provision of one of these agreements conflicts or otherwise is inconsistent with a provision of this Privacy Policy, then the provision of the agreement will prevail to the extent of any conflict or inconsistency.
CHANGES TO THIS PRIVACY POLICY
The Effective Date of this Privacy Policy is set forth at the top of this webpage. As we add new features to the Services, we may need to change this Privacy Policy. We will not make changes that reduce your privacy rights unless you affirmatively agree to the changes. Your continued use of the Services after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions.
INFORMATION WE COLLECT
EDI Institute collects two main types of information through the Services:Personal Information and General Information.
Personal Information means information that, either alone or in combination with other information, can be used to uniquely identify, contact or locate an individual.Personal Information does not include aggregated information to the extent that an individual’s identity cannot reasonably be derived from it or any publicly-available information that has not been combined with non-public Personal Information.Certain subsets of Personal Information, such as information about your location or health status, may be characterized as sensitive under applicable laws, rules or regulations (collectively, “Sensitive Personal Information”) and subject to stricter consent requirements than other Personal Information.
General Information means information that does not uniquely identify any individual. For example, EDI Institute routinely collects and analyzes aggregate statistical information that, by itself, usually does not identify an individual about use of the Services, which we refer to as “Usage Data.”
HOW WE COLLECT INFORMATION
Before providing it to us, we urge you to carefully consider whether to share your Personal Information, especially your Sensitive Personal Information.If you do provide Personal Information to us, you consent to its use and disclosure for the purposes and in the manner described in this Privacy Policy.
The information that EDI Institute collects depends on how you use the Services. For example, we collect:
- Personal Information directly from you when you provide it to us, such as by filling in certain form fields when you register to use the MyMoments App, the http://cloud.mymoments.org or http://resilience.mymoments.org facilitator platform, or contacting us through the “Contact” button on the EDI Website;
- Usage Data automatically when you use the Services;
- Information about a problem with the Services that you report;
- Personal Information when you publish or display ("Post") photographic images (both original and modified versions) and corresponding captions through the Services (collectively, “User Contributions”). Your User Contributions -- including any Sensitive Personal Information contained in them -- are Posted at your own risk because we cannot control what a third party may do with your User Contribution;
- metadata and other information associated with other files stored on your mobile device, such as photographs and address book information.
Usage Data Collection: When you download, access and use the Services, certain technology deployed through the Services automatically collects Usage Data such as:
- the pages, screens and tools that you use through the Services;
- information needed for system maintenance and to improve user experience with the Services, such as operating system and browser type; and
- information about your mobile device or computer, including your mobile device's device identifier, mobile network information and telephone number and your IP address and Internet Service Provider.
Data Collection Technology and Do Not Track: EDI Institute may use cookies and web beacons.
- A “cookie” is a small file cached in a web browser to store information about a user’s use of the Services.A session cookie is active when a user is logged on to the Services and is removed when the web browser window is closed. Persistent cookies are stored in a web browser until deleted.Cookies help EDI Institute monitor and improve the Services by collecting information about IP address, user language, the operating system, browser type, connection type and information that identifies the cookie.Most web browsers automatically accept cookies but you can usually change your browser settings to prevent this. Disabling cookies may limit your ability to use some features of the Services.
- A web beacon (also referred to as clear gif, pixel tag or single-pixel gif) is a transparent graphic image used in tandem with cookies that enables EDI Institute to record a user’s actions.EDI Institute uses web beacons to count users who have visited those pages, verify system and server integrity and for similar statistical measures.
Certain Parts of the Services may include social media buttons, such as Facebook, Inc.’s “like” button. When you visit a page of the Services that displays a social media button, your browser will establish a direct connection to the social media platform’s server in order to load the button and record the page of the Services visited. EDI Institute cannot control the information collected when you click on a social media button but the social media platforms generally state that they do not collected Personal Information unless you are logged onto to your social media account and click the corresponding social media button.Clicking a social media button even if you are not logged into your corresponding social media account may enable the social media platform to collect certain data, such as your IP address. EDI Institute also uses web analytics tools -- including Google Analytics and DoubleClick -- to understand how users engage with the Services.Web analytics tools generally track users’ interactions with the Services and collect information about how the Services are used. EDI Institute uses this information to compile reports that help improve the Services.

HOW WE USE YOUR INFORMATION
We use information that we collect about you or that you provide to us to:
- Promote, offer, or improve the Services.
- Fulfill any purpose for which you provide information to us;
- Carry out our obligations and enforce our rights arising from any contract entered into between you and EDI Institute;
- Notify you when updates for the MyMoments App are available and to update and upgrade the Services;
- Estimate usage patterns; and/or
- Recognize you when you use the Services and store information about your preferences.
DISCLOSURE OF YOUR INFORMATION
EDI Institute may disclose General Information without restriction. EDI Institute may disclose Personal Information:
- To contractors, service providers and other third parties that help us operate the Services;
- To a successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other transfer of some or all of our assets in which Personal Information held by us about users of the Services is among the assets transferred;
- To fulfill the purpose for which you provide it;
- For any other purpose disclosed by us when you provide the information;
- With your consent;
- To comply with any court order, subpoena, search warrant, regulation, binding order of a data protection agency, governmental request or other legal or regulatory process;
- To enforce our rights arising from any contracts entered into between you and us; or
- If we believe disclosure is necessary or appropriate to protect our rights, property or safety of others.
ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION
You may also send us an email to edi@EDIInstitute.org to request access to, correct or delete any Personal Information that you provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. Your Personal Information may remain viewable in cached and archived pages or copied or stored by other users of the Services even after you or EDI Institute deletes it from the Services.
YOUR CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83 permits users of the Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We do not currently disclose Personal Information to third parties for their direct marketing purposes.
If you are a California resident under age 18 and are an authorized user of any of the Services, then you may request that we remove any User Contribution that you publicly Posted through the Services. To request removal of your User Contribution, please send an email with a detailed description of your specific User Contribution to edi@EDIInstitute.org. EDI Institute reserves the right to request that you provide information that will enable us to confirm that the User Contribution that you want removed was created and Posted by you.
We will make a good faith effort to delete or remove your User Contribution from public view as soon as reasonably practicable. Please note, however, that your request that we delete your User Contribution does not ensure complete or comprehensive removal of your User Contribution. Your User Contribution may remain on backup media, cached or otherwise retained by us for administrative or legal purposes or your User Contribution may remain publicly available if you or someone else has forwarded or re-posted your User Contribution on another website or service prior to its deletion. We may be required by law to not remove or allow removal of your User Contribution.
CHILDREN
The Services may permit certain authorized users to process information about children.All authorized users of the Services processing information about children are contractually required to obtain verifiable parent consent before using the Services to process information about children under age 13.If we learn we have collected or received Personal Information from a child under age 13 without verifiable parental consent, we will delete that information. If you believe we might have any information from or about a child under age 13 without parental consent, please contact us at edi@EDIInstitute.org.
INFORMATION RETENTION
EDI Institute retains information as long as it is necessary and relevant for our operations. We also retain Personal Information to: comply with applicable law; prevent fraud; resolve disputes; troubleshoot problems; assist with legal and other investigations; enforce the Terms of Service and other contracts; and other actions required or permitted by law. When Personal Information is no longer needed for our business purposes, we dispose of it subject to applicable law.
INFORMATION PROTECTION
EDI Institute takes administrative, physical and technical precautions intended to help protect Personal Information that we collect and store.Unfortunately, however, no security measure is 100% secure.We cannot guarantee the security of information transmitted to or by us.EDI Institute expects that you will use appropriate security measures to protect all information you submit to us.
You are responsible for keeping confidential your log-in credentials, passwords or other forms of authentication involved in obtaining access to password-protected or secure areas of the Services.Access to the Services through your log-in credentials will be treated as authorized by you.Unauthorized access to password-protected areas is prohibited and may lead to criminal prosecution.
If you believe that information you provided to or through the Services is no longer secure, please notify us immediately at edi@EDIInstitute.org. We may suspend your use of all or part of any of the Services, without notice, if and when we suspect or detect any breach of security.
